The problem is with the GPL side.  The GPL does not permit distribution
of a "work as a whole" that is not entirely GPL compatible.  The FSF
asserts that the CPL is not GPL compatible (for GPLv2 because of the
patent clauses, for GPLv3 because of the choice of law clause).

Lacking case law, their assertion regarding compatibility would seem to
be definitive.
